The following terms and conditions ("Terms and Conditions") apply to the Users (referred to as "You") who access our website and/or our apps through the Medica Wing platform. By registering on the Medica Wing portal or Medica Wing app (collectively referred to as the "Medica Wing Platform"), you acknowledge and agree to be bound by the provisions stated in these Terms and Conditions.

Please carefully review these Terms and Conditions, as well as the Privacy Policy and all other rules and policies available on the portal or app, as they will govern your usage of the Medica Wing platform. Your registration and use of the Medica Wing platform signify your acceptance of (1) these "Terms and Conditions," and (2) Medica Wing's Privacy Policy and any other updated terms. If you do not agree to any of these terms, please refrain from registering or using the Medica Wing platform.

Medica Wing, also referred to as "us," "we," "our," or "Company," is the registered owner and operator of the domain name, website, and apps. Our registered office is located at D-220, Vibhuti Khand, Gomti Nagar, Lucknow (Uttar Pradesh).

Medica Wing PLATFORM

1. These Terms and Conditions govern the usage of the Medica Wing Platform by all Users. The platform includes any services or applications introduced by Medica Wing from time to time.
2. The Medica Wing Platform serves as an online platform that provides support and guidance to Undergraduate and Postgraduate aspirants with counseling information. It acts as an aggregator and translator of counseling information and expertise available in the public domain, organizing it into structured content to enhance accessibility. The information uploaded on the Medica Wing Platform is referred to as "Organized Content."
3. You acknowledge and agree that Medica Wing acts solely as an intermediary for sharing available information in a translated visual form and has no control over or responsibility for the source of the content. By using the Medica Wing Platform, you release Medica Wing from any liability arising from the Organized Content.
4. The Medica Wing Platform may contain links to third-party websites or counseling platforms that may or may not be owned or controlled by Medica Wing. Medica Wing bears no responsibility for the content, privacy policies, or practices of these third-party websites. Additionally, Medica Wing does not censor or edit the content of any third-party site. By using the Medica Wing Platform, you release Medica Wing from any liability arising from your use of third-party websites or services. However, it is recommended that you carefully read and understand the terms and conditions and privacy policies of each website you visit.
5. Subject to these Terms and Conditions, Privacy Policy, and other rules and policies made available elsewhere, Medica Wing grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Medica Wing Platform in accordance with these terms.
6. You acknowledge that Medica Wing reserves the right to change or discontinue any aspect or feature of the Medica Wing Platform, including the Organized Content, availability period, and the necessary equipment or devices for access. Medica Wing may also discontinue the dissemination of certain information categories, change transmission methods, or modify transmission speeds and other signal characteristics. Medica Wing reserves the right to refuse access to the Medica Wing Platform, terminate accounts, or remove/edit content without prior notice.

Medica Wing ACCOUNTS

To access certain features of the Medica Wing Platform, you may need to create an account. You agree not to use another user's account or provide third parties with access to your account. When creating your account, you confirm that the provided information is accurate and complete. Furthermore, you are solely responsible for any activities that occur on your account and must keep your account password secure and not share it with anyone.

If there is a security breach or unauthorized use of your account, you must notify Medica Wing immediately. Medica Wing shall not be liable for any losses caused by unauthorized use of your account. You are solely responsible for any losses incurred by Medica Wing or others due to such unauthorized use.

ACCESS, PERMISSIONS AND RESTRICTIONS

Medica Wing grants you permission to access and use the Medica Wing Platform under the following conditions:

1. You agree not to distribute any part of the Medica Wing Platform or its content without prior written authorization from Medica Wing.
2. You agree not to use or launch any automated system (e.g., scrapers, robots, spiders, offline readers) that accesses the Medica Wing Platform in a manner exceeding the request capacity of a human using a conventional web browser.
3. Notwithstanding the above, Medica Wing permits public search engines to use spiders to copy materials from the site solely for creating publicly available searchable indices. However, caching or archiving of such materials is not allowed. Medica Wing reserves the right to revoke these exceptions, either generally or in specific cases, with or without notice.
4. You agree not to collect personally identifiable information, including account names, from the Medica Wing Platform, or use the platform's communication systems (e.g., comments, email) for commercial solicitation purposes. You also agree not to solicit other Medica Wing Platform Users for commercial purposes regarding the Organized Content.
5. You may post reviews, comments, and other content, send communications, and submit suggestions, ideas, comments, questions, or other information as long as the content is legal, non-obscene, non-threatening, non-defamatory, respects privacy, does not infringe on intellectual property rights, and is not injurious or objectionable to third parties. Additionally, the content must not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any other form of spam.

By submitting content, you grant Medica Wing a royalty-free, worldwide, non-exclusive license to use the Organized Content and communications for developing the Medica Wing Platform and any marketing or promotional activities.

USAGE OF CONTENT

Apart from the general limitations mentioned above, the following restrictions and conditions apply to your utilization of the Organized Content.

The Organized Content is provided to you on an "AS IS" basis. You may access the Content for your personal use and information solely as intended through the provided functionality on the Medica Wing Platform and as permitted under these Terms and Conditions. Unless a "download" or similar link is displayed by Medica Wing on the Medica Wing Platform for that Organized Content, you should refrain from downloading any Organized Content.

You are prohibited from engaging in the following activities without the prior written consent of Medica Wing or the respective owners of the Organized Content: copying, reproducing, making available online or electronically transmitting, publishing, adapting, distributing, transmitting, broadcasting, displaying, selling, licensing, or otherwise exploiting any Organized Content for any purposes other than as provided herein. Medica Wing reserves all rights not expressly granted in and to the Medica Wing Platform and the Organized Content.

You agree not to bypass, disable, or interfere with security-related features of the Medica Wing Platform or features that prevent or restrict the use or copying of any Organized Content or enforce limitations on the use of the Medica Wing Platform or the Organized Content therein.

While using the Medica Wing Platform, you acknowledge that you will be accessing Organized Content from a variety of sources, including counseling authorities, regulatory boards, educational and legal websites, and that Medica Wing is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content.

Furthermore, you understand and accept that you may come across Content that is inaccurate, offensive, indecent, or objectionable. You agree to waive any legal or equitable rights or remedies you have or may have against Medica Wing with respect to such Content and, to the extent permitted by applicable law, you agree to indemnify and hold harmless Medica Wing, its owners, operators, and affiliates, to the fullest extent allowed by law regarding all matters related to your use of the Medica Wing Platform.

CONTENT AND CONDUCT

1. As a user of Medica Wing, you have the ability to submit Content on the Medica Wing Platform, including user comments or responses in discussion forums. You understand that Medica Wing does not guarantee any confidentiality with respect to any content you submit.
2. You are solely responsible for your own Content and the consequences of submitting and publishing such Content on the Medica Wing Platform.
3. Furthermore, you agree that the Content you submit on the Medica Wing Platform will not contain third-party copyrighted material or material that is subject to other third-party proprietary rights unless you have obtained permission from the rightful owner of the material or are otherwise legally entitled to post the material and grant Medica Wing all of the license rights granted herein.
4. Additionally, you confirm that the Content uploaded by you is not:

6. Infringing upon any third party's copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy
7. Violating any law, statute, ordinance, or regulation
8. Defamatory, unlawfully threatening, or unlawfully harassing
9. Obscene or containing pornography
10. Containing any viruses, trojan horses, worms, cancelbots, or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information
11. You understand and confirm that, during your use of the Medica Wing Platforms, you will not at any time post or publish any content, comments, or engage in any activities that amount to the harassment of any other user. If Medica Wing becomes aware that you are involved in any form of harassment towards other users.

Medica Wing - INTELLECTUAL PROPERTY RIGHT

Ownership and Protection:

The Medica Wing Platform, including its content, design, structure, and code, is owned and controlled by Medica Wing. All intellectual property rights, including copyrights, patents, and trademarks, protect the platform. The selection, arrangement, coordination, expression, look and feel of the content on the platform are also protected.

Trademark:

The trademark "Medica Wing" is the exclusive property of Medica Wing. Any reproduction, in whole or in part, of the trademark without express written permission from Medica Wing is strictly prohibited.

Refunds:

Refunds will be processed in accordance with Medica Wing's refund policy. However, voluntary contributions received from users, before the launch of the packages, do not fall under the refund policy. These contributions are not for any services provided by Medica Wing and cannot be claimed as a refund.

Electronic Communication:

By visiting the Medica Wing Platform or sending emails, you consent to receive electronic communication from us. We may communicate with you via email, text message updates, or by posting notices on the platform. Such electronic communication satisfies any legal requirement for written communication.

Termination of Account:

Medica Wing may terminate a user's access to the platform if they are a repeat copyright infringer, breach the terms and conditions, disrupt business operations, or engage in inappropriate, unlawful, or claim-worthy behavior.

Disclaimer:

Your use of the Medica Wing platform is at your sole risk. Medica Wing, its officers, directors, employees, and agents exclude all warranties, express or implied, regarding the platform. Medica Wing is not liable for any errors, personal injury, property damage, unauthorized access, interruption of transmission, bugs, viruses, or any loss or damage incurred from using user content or third-party services.

Indemnity:

You agree to defend, indemnify, and hold harmless Medica Wing, its parent corporation, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or debt arising from your use of the platform, violation of the terms, infringement of third-party rights, or any applicable laws.

Eligibility and Acceptance of Terms:

By using the Medica Wing Platform, you affirm that you are at least 18 years old or have legal parental or guardian consent. Medica Wing reserves the right to refuse access or suspend existing user accounts without providing reasons.

Force Majeure:

Medica Wing shall not be liable for any failure or delay in performing its obligations due to events beyond its control, such as acts of God, government actions, war, terrorism, natural disasters, strikes, epidemics, civil unrest, power outages, or severe weather.

Information Technology Act:

These Terms and Conditions comply with the Information Technology (Intermediaries guidelines) Rules, 2011, and any other applicable laws. Medica Wing will maintain data and personal information in compliance with these laws.

 

OTHER LAWS

Certain laws require to maintain data with respect to the Medica Wing Platform and other personal information in a prescribed format and Medica Wing will use all the information to the extent required in compliance with the applicable laws and as may be directed or amended from time to time.

Governing Law and Jurisdiction:

The Terms and Conditions are governed by the laws of India, and you submit to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.

Modification, Amendment, or Termination:

Medica Wing may modify or revise these Terms and Conditions at any time, and your continued use of the platform signifies your acceptance of the modifications. Third-party rights or benefits are not conferred by these Terms and Conditions.

General:

If any part of these Terms and Conditions is deemed unlawful, void, or unenforceable, it will not affect the validity and enforceability of the remaining provisions. Medica Wing does not guarantee uninterrupted access to the platform and is not liable for breaches by.
